Changing child custody and changing child visitation are two very different things with completely different processes. Some parents will seek to modify child custody because it will be easier to visit more often with the children however, if the court orders a specific visitation schedule then the type of custody won’t matter. Changing custody in Arizona is not as easy as most believe however, the process for changing the visitation schedule is quite straight forward and getting a hearing is quicker. It’s possible the court may even deny a request for hearing when trying to modify Custody. The Arizona Rules of Family Law Procedure distinguishes the two different cases and processes.
