The process for a legal separation is similar to a divorce in that a Petition for Legal Separation is filed and there is a 60 day waiting period before a Decree of Legal Separation is ordered. The parties are declared legally separated and the issues of assets, debts and children’s issues are still ordered. The findings for a legal separation are defined in ARS 25-313. We will prepare the legal separation documents and include the appropriate language according to your instruction to ensure your legal separation is executed as smoothly as possible. In the event that you want to divorce after a Decree of Legal Separation is entered then the parties must file a Petition for Dissolution of Marriage (Divorce) to begin the same process and wait the 60 day waiting period once more.
